论过户登记与房屋买卖合同效力的关系

摘    要:房屋买卖是典型的不动产买卖,尽管不动产物权变动原则在我国立法上采取登记要件主义,但房屋买卖合同是从合同订立之时成立生效,还是从合同双方合意并办理了过户登记手续时才成立生效,也就是说过户登记能否影响房屋买卖合同的成立与生效这一问题一直争论不休.目前,这种对房屋买卖合同效力认识不一的状况,极大地妨碍了法律适用的统一,既不利于保护当事人的合法权益,也不利于保障房地产市场的健康发展.本文力求从理论联系实践的角度阐释过户登记并不是房屋买卖合同的成立和生效要件,不能影响房屋买卖合同的成立与生效.

Abstract:The transaction of house is a kind of typical transaction of real estate.Although the system of the real estate's conveyance is registration system in the law of our country,when the contract comes into force is still a vexed question.Now this situation is detrimental to the unity of law,the interest of parties,healthy development of real estate market and judicial system.The paper tries to settle the problem from the angle of theory and practice.
