| 摘 要： | 1996年刑事诉讼法修改在普通程序之外增设了简易程序。从近几年的司法实践来看,简易程序对提高诉讼效率确实起到了积极作用,收到了一定效果,但目前适用简易审程序的比率还相当低。引进外国的“辩诉交易”制度,既有利于简易审程序的适用与完善,也有利于正确把握简易审与公正效率的辩证关系。

| Abstract: | In 1996,the simplifying procedures was super induced to the penal litigation,which was proved to be efficiency by the judicative practices and it did make some achievements.However,considering the statistical figures that the adjustment rate is relatively low.This chapter is mainly how to introduce the foreign of dialectic deal.And it is concerning the relation among the simplifying conventional trial procedures and justice and its efficiency. |
