| 摘 要： | 《土地管理法》第七十三条存在立法瑕疵，《土地管理法》和《城镇国有土地使用权出让和转让暂行条例》的有关规定对受让方缺乏规范约束力，使非法买卖土地和转让土地的法律适用、法律责任追究成了困扰国土资源执法的难点，需要在产法中加以完善。

| Abstract: | There exists flaw in Article 73 of Land Administration Law.Regulations in land Administration Law and Provisional Regulations on Transferrence of Urban State land produce little authority on the transfenrred,which malces law application and responsibility hard to enforce and needs to be perfected in legislation. |
