论区域习惯在多元民事纠纷处理机制中的有效运行

我国已经初步建立了较为科学地处理民事纠纷的多元化并行的多种运行体制,但现有研究没有把人民调解放在应有的地位,而是重在研究仲裁与诉讼的优势。各国法治现代化的进程不同,对其他国家法律的移植应当充分考虑我国国情,没有相应的社会环境与配套制度,移植过来的先进法律仅具有观赏性而不具有实用性。在多元民事纠纷处理机制中应当更多地挖掘本土文化的有益部分,使区域习惯在多元民事纠纷解决机制中得到有效运行,促进人类社会的和谐发展。

Effective Operation of Regional Customs in the Mechanism of Dealing with Disparate Civil Disputes

China has preliminarily established several comparatively scientific operative systems of dealing with disparate civil disputes.The researches conducted up till now have put emphasis on studying the advantages of arbitration and litigation,attaching no due importance to people's mediation.However,owing to the different processes of modernization of the legal systems in different countries,the fundamental realities of China should be taken into account in implanting other countries' laws,for,without relevant social contexts and supporting systems,the implanted advanced laws are not practically useful but only serve as ornamentation.Therefore,we should make full use of the advantages of regional culture to effectively operate regional customs in dealing with disparate civil disputes and to promote the harmonious development of human society.
