| 摘 要： | 教育刑制度指在保持刑罚惩罚性的基础上,教育犯罪人不再犯罪的刑罚制度。其完善要摒弃重刑主义,大力推行司法改革,刑法应当进一步体现教育刑思想。

| Abstract: | This paper tries to suggest that on the basis of keeping the punishment of penalty, in all aspects of the leading thought of penalty, the criminal legislation and the criminal judicature. In brief, China's educational penalty system ought to be perfected as soon as possible. |
