诞生于革命根据地时期，延续了中国古代司法传统，踏着清末及民国司法制度的废墟，经过苏联社会主义司法制度、西方司法制度的洗礼，在社会主义初级阶段的国情环境下形成的具有鲜明的政治性、广泛的人民性和充分的公正性为主要特征的人民司法制度，还存在司法观念脱离实际、司法管理粗放、司法监督缺位等不足，亟需我们端正司法理念、创新司法管理、健全司法监督，不断完善中国特色社会主义司法制度。
