继承与超越:社会资本与中国的社会主义民主宪政之路

中国是一个社会资本传统厚重的国家,要实现现代化的宪政文明逃不开这种特定的历史背景环境。有些社会资本可以促进现代宪政文明建设,有些却不可以,甚至会阻碍它,因此对社会资本传统既要继承,更要超越。以自由主义为思路的宪政设计路向不符合中国的社会资本形态,中国的宪政之路在于社会主义民主宪政,这种宪政的建设方案允许精英民主甚至威权成分的残留,当然这是一种过程性质的。中国民主宪政函数中的民主将从中国的“重民”和人们之间的互惠、信任、自治传统中生发。

Inheritance and Transcendence: Social Capital and the Road of China's Socialistic Democratic Constitutionalism

China is a country with a profound tradition of social capital.The realization of modernized constitutional civilization can not be disconnected from this specific historical background.Some of the social capital can promote the construction of constitutional civilization,some can't,and some even will hinder the construction.Therefore,both inheritance and transcendence are expected in dealing with the tradition of social capital.The constitutional design based on liberalism doesn't accord with China's social capital form.China's constitutional road lies in socialistic democratic constitutionalism,inside the building programs of which some elite democracy and even some remnants of authoritative elements are tolerated.Democracy in China's democratic constitutionalism can be generated from the mutual benefits,mutual trust and autonomous tradition between VIP's and common people in China.
