科学发展观视角下的环境刑法立法完善

加强环境保护是落实科学发展观的重要举措，环境刑法的根本目的是保护环境法益，而我国现行刑事立法只注重对环境犯罪侵害人身、财产法益的保护。本文通过分析现行立法制度，提出对环境犯罪的构成要件应做出修改，扩大刑法的环境保护范围，落实环境保护“预防为主”原则，加大刑罚处罚力度，采用无过错责任原则。希望文章能为我国环境刑法理论提供参考。
