行政相对人问题是行政法学上的一个新的课题，无论在行政法的学理上还是在行政法的制定上都是一个既成用语，但是由于学者的观点不统一，行政法学界对其认识常发生混用的现象。随着法治理念以及法治国家建立的提出，行政相对人的地位日趋提高，对其进行研究也是当务之急。通过对各国立法规定以及中外学者的观点进行分析与判断，从而对行政相对人进一步认识。

A Comparative Study of Private Party: From the Angle of Its Intension, extension and Definition

Private party is a new field in the administrative law. It is a colloquial phrase not only in theory but also in the formulation of administrative law. Because scholars have various views about private party, it is always used in a wrong meaning in field. With the idea of government by law and establishment of the country under the rule of law, it is urgent to study private party. This paper analyzes and judges other countries＇legislation and scholarsviews, in order to get a further understanding of private party.
