摘    要:就业歧视是一个世界性难题 ,在不同国家或地区不同程度地存在着 ,中国亦不例外。但遗憾的是 ,它没有引起我国法学界和经济学界的广泛关注和足够重视。首次比较系统地对我国就业歧视的主要表现、缘由、负效应以及现行法律法规的缺限等问题进行了尝试性分析 ;在此基础上 ,借鉴国外相关法律法规 ,立足我国国情 ,提出了我国禁止就业歧视之立法思路。

Abstract:Discrimination on employment is an international puzzle.It exists in different countries or areas to different extent,and so does in China.But it is to be regretted that the problem hasn't called up the jurisprudence circles' and the economics circles' wide concern and enough attention in China.It is the first time the article systematically analyses primary manifestations,causes and negative effects of discrimination on emplyment and drawback of laws and regulations in China.At the same time,with help of the relative foreign laws and regulations,the article brings forward the legislative thinking on forbidding the discrimination on employment by basing upon our national conditions.
