近年来蒙古民族地方法制史研究述评

20世纪80年代初,国内蒙古学、民族学学者开拓了蒙古民族地方法制史的研究,80年代中期,法制史学者开始关注此方面研究.蒙古学领域的研究主要属于纯文化的研究,法制史领域的研究则着重从少数民族习惯法与国家制定法的关系、少数民族传统法制在中华法系中的地位角度进行探讨.蒙古民族地方法制史的研究具有蒙古学、法制史学、民族法学、法律人类学、文化学等多学科、跨学科研究的综合意义,研究重心开始向探究蒙古民族传统法制的文化内涵,探究蒙古传统法律文化的融合能力及现代转换意义这一方向拓展.关于蒙古民族传统法制的地位应有正确认识和定位,它们一方面沟通融合于古代北亚游牧民族法文化与中原农耕民族法文化,一方面也融于中华法系,丰富了中华法系文化.

A Brief Survey on the Study of Local Legal History of the Mongols

s: At the beginning of 1980s of the 20th century,the Chinese scholars of Mongology and ethnology started research on the history of the legal system in Mongol areas. In the middle of 1980s,the scholars of the history of legal system began to pay close attention to it ,too.The research in the field of Mongology belongs to the pure cultural ones,while the scholars who study the history of legal system approached the subject from different angles,such as the relationship between the common law of ethnic groups in Chinese legal family,etc.The research in the history of legal system in Mongol areas is significant because it involves Mongology, history of legal system,ethnology,legal anthropology and so on. At present,the core of research is turned to probing into the cultural intension of traditional legal system in Mongol areas and the merging skills of traditional legal system of Mongol.We should have a correct understanding of traditional legal system of Mongol. On the one hand,it made the legal cultural of nomadic nationalities in North of Asia merge into that of the farming nationalities in central plains,and on the other hand,it mixed into the Chinese legal family and enriched its culture as well.
