| 摘 要： | 没收财产刑中的＂财产＂含义,应当从财产性权利、没收财产刑的刑事责任与财产刑的协调统一等几方面来界定。没收财产刑的具体执行主要存在如下几个问题,即没收财产刑的执行率较低、执行程序不完善、执行监督不完善等问题。没收财产刑的改革思路包括完善执行程序的法律规范、建立没收财产刑的强制措施、完善没收财产刑的监督机制。

| Abstract: | Sentence of confiscation of property should be defined form property confiscated assets and property of criminal responsibility.The Implementation of Confiscation of property has the following questions: the lower executing rate,the unsound implementation and supervision mechalism.The reform of confiscation of property includes: perfecting the law of confiscation of property,establishing the compulsory measures and improve the supervision system. |
