| 摘 要： | 针对我国尚未制定判例法的现状，论述了建立判例法制度的必要性与可行性，指出为适应司法改革的客观要求，我国应建立判例法制度，形成以成文法为主体，判例法为补充的中国特色的社会主义司法制度。

A Tentative Probe on Establishing Case Law System in China |

| Abstract: | It concentrates on exploring the necessity and practicability of setting up case law system in China because now case-law is still not legislated in our country. It is pointed out that in order to fulfill the objective requirements of the legal innovation, case law system should be established. And in order to construct the typical socialistic legal system in China, people should make written law as its main body and case law as its indispensable supplementary. |
