| 摘 要： | 从制度和理性两个层面分析我国目前的农村土地承包经营制度，得出结论：一元化的制度安排不适合中国国情，债权特征的农村土地承包经营权有明显弊端，故我国农村土地承包经营权应朝多元化，物权化方向发展。

| Abstract: | Through analysing the pre sent managerial system of contractor on farmland by means of institutional and r ational method,the author draws a conclusion:on one hand,monism on system is not fit for the present conditions in China;on the other hand,It will be harmful to peasants if the managerial right of contractor on farmland becomes an obligatio n .So adopting pluralism and turing to right in rem is the best choice. |
