| 摘 要： | 农村司法现代化缺失互动机制，现代司法制度在农村实施缺乏适宜的社会生态条件。中国农村司法现代化必须走社会演进与国家推动相结合的道路，要遵循司法现代化的生成规律，给农村地方性知识以多元、宽容的理解；重读农村传统司法文化，构建涵盖农村地方性司法资源的司法现代化；回归司法为民的目的型价值维度，明确农民在农村司法现代化进程中的主体地位。
