关于自然人破产的自由财产制度探究

建立自然人破产制度,对于因为不可抗力因素造成财产丧失的,特别是丧失房屋财产的一些购房人和房子的持有人,在很大程度上有了法律依据来解决这些问题;自然人破产制度中的自由财产制度可以使自然人从长期的债务压力下解放出来,自由财产制度为自然人保留了生活所需的必要财产和职业上需要的工具,不至于使债务人破产后生活陷入绝境,维护了债务人的生存权和发展权;分析了自有财产内涵及自由财产制度构建的意义,结合我国当前各种相关规定及设计情况,提出了我国自由财产制度设计的方式。

On Exploring Free Property Regulation of Natural Person Bankruptcy

Enacting NPBR abbr.Natural Person Bankruptcy Regulation provides the legal basis to greatly solve these problems including some house hunters and house holders,who lost their properties,especially their houses because of force majeure.Liberty Property Regulation in NPBR is going to liberate natural persons from their long-term debts.Liberty Property Regulation retains necessary living properties and professional tools for natural persons,and does not make debtors desperate after bankruptcy so as to maintain the debtor＇s survival rights and development Rights.This paper analyses the connotation and the construction significance of Free Property System and put forward to the design style of Free Property System in China by combining current various corresponding regulations and designs in our country.
