摘    要:法律规定的教师聘任制实行学校和教师双方地位平等的原则,聘任关系的建立、维持和终止都应遵循法律规范。实施教师聘任制受到教育行政行为的干扰和支配,法律规定和实践行为存在矛盾和冲突。解决问题的办法是从立法和实践两方面加以改进和完善。

Abstract:The Teacher's Engagement System provided by law has a priciple that the relation ship between school and the teacher is equal.It's certain that to establish , keep or end the engagement should follow the legal provisions, still there are contraditions and conflicts between the legal provisions and the implementing, because the educational administration dominates and interferes in the engagement. The way to solve this problem is to make better both on the legislation and the practice.
