国家精神损害赔偿问题探析

精神损害虽然无形却是客观存在的.对于一些受害人来讲,精神上的损害远甚于物质上的损害,如果不对其进行精神上的抚慰和赔偿,有失法律的公平.我国私法领域的精神损害赔偿已在立法、司法上得到了肯定,而在公法领域国家对公民造成的精神损害,是否应该进行赔偿,法律制度上却是不置可否.精神损害赔偿既然已在私法领域得到了确认,那么就不应因侵权主体的不同而采用不同的法律标准.国家精神损害赔偿是法治社会所需,且我国实施国家精神损害赔偿的条件已经成熟,不存在阻碍.

A Study of the Compensation for Mental Damage Caused by the State

The mental damage is invisible,but it actually exists.To some victims,spiritual hurt is much worse than physical damage.In our country,when people suffer mental damage,they can get compersation according to the civil law,but in the public law,such people can not get any compersation at all,which is extremely unfair.Since compensation for mental damage has been confirmed in the privite law field,we can not use different law criterions because of different plaintiffs.The compensation for mental damage caused by the state is a must for a society governed by law,and what's more,we have already had the conditions to do so in our country and nothing prevents us from doing so.
