高校科研成果市场转化的法治保障研究

摘    要:高校科研成果市场转化对于我国经济发展与产业升级换代十分重要。但当前高校科研成果市场转化现状不容乐观。透过域外立法经验发现我国当前高校科研成果市场转化立法存在滞后、可操作性弱、认识不到位、规范性文件位阶较低以及主体不明确等问题。因此,需要采取完善立法、提高规管市场转化立法认识、提升规范性文件的位阶、立法中明确市场转化主体等措施,改善高校科研成果市场转化环境,促使产学研结合、经济与科技共同发展与有机结合,推动科教兴国。

Abstract:The market transformation of scientific research achievements in HEIs is of great importance to China''s economic development and industrial upgrading. However, the current market transformation of scientific research achievements in HEIs is not optimistic. Through the extraterritorial experience, it has been found that the current legislation on the market transformation of scientific research achievements in China is characterized by lagging-behind, weak operation, poor understanding, low level of normative documents and unclear subject. Therefore, it is necessary to amend the legislation, raise the awareness of regulation on market transformation, improve the level of normative documents, and clarify the main body of market transformation in the legislation, so as to improve the environment for the market transformation of scientific research achievements in HEIs, promote the industry -university -research integration and the joint development of economy and science & technology, and achieve the rejuvenation of our country by science and education.
