| 摘 要： | 由于中国宪法的急剧变迁与法治建设的深入推进,近30年来中国宪法学理论体系构建方法发生了巨大的变化。第一阶段(上世纪90年代)基于基本范畴构建宪法学理论体系,出现了宪法过程论、人民主权起点论、法权起点论等代表性观点;第二阶段(本世纪初)基于科学功能构建中国宪法学理论体系,出现了宪法解释学、规范宪法学、历史宪法学等有影响力的流派。笔者以为,随着认识的深入与各种视角的整合,未来宪法学将基于系统功能重构宪法学理论体系。
