| 摘 要： | 随着经济的发展及中国加入世贸组织后,原来民法通则关于人格权的规定已经不能适应时代发展的需要,笔者对现行民法关于人格权规定进行检讨,指出完善人格权制度的必要性,并结合时代发展,特别是十六大"人权入宪"的时代条件,重新对人格权法(草案)作出检讨,并提出矫正措施.

| Abstract: | Along with economic development and China affiliation world trades after organizing, originally civil law then the provision concerning personality power has can't adapt to the demand of the ages development, writer to current civil law the concerning personality power provision proceeds to review, pointing out the institutional provision in power in perfect personality, combining the combinative ages develop, especially the times of 16 greatest" human rights into Constitution"s term, make to the personality power method( drafted plan) afresh review, and put forward to correct the measure. |
