审判进程视角下的刑事错案防范机制探究

刑事错案在整个司法进程中均可能发生，但审判阶段发生的刑事错案危害最大。通过刑事错案防范机制来避免具体的错案理当是可行的。以案件在法院审理阶段的进程为对象，通过审理前阶段的严格审查受理案件和适时召开庭前会议，审理中阶段的严格贯彻执行法定证明标准，强化证据审查、逐步扩大证人、鉴定人出庭的适用范围以及通过庭审旁听、直播等监督审理，审理后开展案件评查和审务督查、判决书上网和加强审判管理机制等措施，对其中可能产生的错案因素进行梳理和探讨，以避免刑事错案的产生。

The Prevention Mechanism of Criminal Misjudged Cases f rom the Perspective of Trial Process

T he criminal misjudged cases may occur in the w hole legal process ,and are most harmful in the trial stage .It is feasible to design prevention mechanism in the process of trial to avoid this phenomenon . The prevention mechanisms are as follows ：strictly examining the cases and timely holding meetings in the pre-trial process ;strictly carrying out the legal proving standard ,strengthening the examination of evidence , gradually expanding the scope of the witnesses and surveyors ,implementing some supervision mechanisms as auditing and live telecast in the while-trail process ;taking measures to strengthen the trial management such as commenting and examining the cases ,publishing the judgment on the Internet to comb the likely factors of misjudging and explore more effective prevention mechanisms in the after-trial process to prevent the genera-tion of criminal misjudged cases .
