探析我国刑法借鉴广义缓刑之可能

缓刑制度以矫正为本质的价值取向,征服了许多国家包括我国的立法者。我国的缓刑制度属于狭义的暂缓执行的刑罚制度。在此基础上,我国应充分借鉴广义缓刑的缓宣告制度,从而可以减小"轻罪入刑惩罚过大"的矛盾,帮助轻罪、未成年人犯轻罪、防卫过当等等的行为人更加顺利回归社会。这一借鉴体现了人类的理性和对良法的追求,为我国刑法朝向轻刑、注重人权、有机统一等方向发展发挥功效。
