| 摘 要： | 远洋渔工非法出入境治理问题既是当下行政管理模式从管制转向治理的行政法学理论课题,也是海港边检站面临的行政管理现实问题。从分析远洋渔工违法形态和现有行政管理模式入手,立足解决现实问题,对构建刚柔相济的海港边检行政治理模式进行了探讨,以求实现海港边检行政的“善治”。

| Abstract: | Dealing with illegal immigrated ocean fishermen is not only a subject of transforming administration system from compulsion to scientific management,but also a practical subject that port frontier inspection gate is facing.By analyzing irregularities of ocean fishermen and current administration system,this paper aims at solving practical problems,probing into subject of building administration system by hard and soft measures,and managing system of port frontier inspection gate so as to realize the goal of "human administration". |
