| 摘 要： | 所有权保留作为一种实用、简便的担保制度,以权利所有和利益享用的一时分化为表征,旨在实现交易安全.我国关于所有权保留制度的简约规定,远不能应对纷繁复杂的商事行为.通过具体个案,分析所有权保留制度的指向对象和可行类型,探讨出卖人取回权、第三人留置权实现问题.

| Abstract: | Ownership reservation as a kind of practical and simple guarantee system,with the feavture of the right and the benefits being divided at a time,aims at realizing transaction safety.In our country the related simple provision,can't responed to the complicated business behavior.With individual cases examined,the pesent paper analyzes the directed object of the ownership reservation and its type,and inquires into the realization of the take_back power and the wager power of the third person. |
