| 摘 要： | 《侵权责任法》第77务明确了高度危险责任限额赔偿制度,其正当性之争及适用问题成为侵权法领域中的重要议题.国内外高度危险责任限额赔偿的法律发展表明,该制度在各国侵权法中不具有系统化特征.从高度危险责任制度的设立目的、严格责任的本质特征以及节约社会成本等角度分析,限额赔偿制度在理论上缺乏正当性.在最终废除高度危险责任领域中的限额赔偿制度之前,我国有必要正确理解和适用相关法律条文,并适时调整最高限额.

| Abstract: | Article 77 of Tort Liability Act provides the compensation limits of high-risk liability.The dispute over its legitimacy and the application become important issues in the area of tort law.The relevant legal developments indicate that compensation limits do not have systematic characteristics in the tort law system.In the perspective of the purposes of introduing high-risk liability,the essential characteristic of strict liability and social cost savings,the compensation limit system,in theory,lacks justice.Before repealing the quota system of compensation,it is necessary to correctly understand and apply the relevant legal provisions,and adjust the ceiling. |
