清末新政时期刑律监狱制度改革

晚清王朝 ,内忧外患 ,国势日衰 ,统治者为维护其统治 ,实施“新政”。刑律监狱制度改革是其重要内容 ,主要包括 :修订新刑律 ,尝试司法独立 ,培养新式监狱人才 ,设立新式模范监狱。改革与清朝守旧势力所代表的中国传统封建思想文化产生激烈冲突归于失败 ,但极大地推动了中国法律近代化的进程。

The Reform of the Penal Laws and Jail Systems in the New Policy Period of the Lafer Qing Dynasty

In the later Qing dynasty, the country was in trouble in and out, and the power became weaker and weaker. In order to defend his authouity, the ruler enforced the New Policy,and one of the important contente was the reformation of the penal laws and the jail systems, it included the following items: making new penal laws, trying establishing an independent department of justice, training a new type of administrators for jails, and setting new examples of jails,etc. The reform had extremely prompted the modernizing process of the Chinas laws, though it failed in the end for the drastic collision with the traditional minds and cultures that the conservative persons held.
