| 摘 要： | 介绍我国关于侵犯财产罪法益的几种学说，并指出了他们的不足之处，同时介绍了国外侵犯财产罪法益的各主要学说，在此基础上提出了平稳占有制度的观点，而且论证了此制度成为侵犯财产罪法益的必要性。
