| 摘 要： | 1991年民事诉讼法增设了督促程序,但十几年的司法实践效果并不理想.本文从督促程序的历史渊源、中外司法实践的比较分析及改进我国立法的对策等方面进行论述,希望完善督促程序,以发挥其应有的作用.

| Abstract: | In 1991 supervising procedure was added in civil action which has unsuccessful effect during over 10 years practice. The paper analyzes this problem from several aspects as follow: supervising history, the comparison between judicial practice in China and foreign countries, and the countermeasures of legislation. |
