| 摘 要： | 早在两千多年前，柏拉图就曾谈到城邦公民习惯对于政治制度具有决定作用，但国民习惯如何影响制度正义，学界尚未有明显结论。正义是一种价值判断标准，制度内涵本身就包含着对人的习惯、尤其是社会人的习惯的考虑。国民具有地域性，并受文化传统的影响，从而形成国民习惯。制度的建立、运行及评价都需要考虑国民习惯，只有考虑国民习惯的制度才是正义的。

| Abstract: | Plato argued that citizen habits have decisive effect on political system about two thousands years ago. Since then scholars have not reached an agreement about why and how citizen habits affect the system of justice. Justice is one kind of judgmental standards for values, and system in itself involves thinking about individual habits, especial those of a social unit. Citizens are characterized as regional, influenced by cultural traditions, and therefore form citizen habits. To realize justice in the foundation, operation and judgment of system needs considering citizen habits. |
