反垄断法中听证制度之引入

听证制度给全社会尤其是相关利益团体一个正式的表达机会,在其它行政行为中的运用已取得了一定的成果并积累了相当的经验。我国公众缺乏对反垄断行为的实质性参与权。反垄断法中引入听证制度,使行为当事方、具有充分竞争利益关系的第三人、企业主管机关、职工、供应商、消费者以及消费者协会等享有参加听证的权力,听证既可自下而上申请,也可由反垄断执法机构主动进行。
