| 摘 要： | 战斗精神是军队战斗力的重要组成部分,是决定战争胜负的重要因素。法制的激励和规约是强化战斗精神的有效途径。春秋时期,秦国实行的军功爵制,有效地激发了秦军的战斗精神。军功爵制体现了富国强兵的立法价值取向,有效聚合了秦国的尚武风尚,并通过厚赏严罚的制度设计,促使秦国尚武民风转化为战斗精神;在法律实施过程中,又以政府公信力为基础,确保法律实施的自觉性和有效性。
