论职务侵权责任的性质及其法规范的制定和适用

本文结合我国《民法通则》、《国家赔偿法》等法规范的相关规定,在辨析民事赔偿责任和国家赔偿责任之间关系的基础上,对国家机关及其工作人员职务侵权责任的性质进行了重点分析,接着对《国家赔偿法》和民法等法关于职务侵权责任的规范之间的关系、尤其是法规范适用的关系进行了有益的探讨,并对三部民法典草案建议稿相关规定的立法技术进行了评析。

On Nature of Official Tort Liability and Legislation and Application of Its Norms

Through differentiating and analyzing Tort Indemnity and State Indemnity,combining related law and regulations of General Rules of Civil Law,and State Indemnity Law,this article makes great analysis of related law and regulations of three propositional drafts of Civil Law,and it discusses on the problems of the nature of official tort liability in state offices and its civil officials,and on the relation between official tort liability stipulated in State Indemnity Law and Civil Law,especially the relation of application,and finally,on the techniques of legislation of three propositional drafts of Civil Law.
