法理的社会学分析

法理亦即法本质。法本质隐藏于法现象，法现象则根植于社会历史。社会既是社会实体，也是社会关系或社会结构。社会结构实际上是拥有不同的给利能力和加害能力的社会实体所生成的利害格局。以此为基准，社会历史呈现为平等、冲突、合作三种类型。作为社会关系的调节机制，法是社会结构的动态反映，也是社会实体的博弈结果。法的本质在冲突社会首先是暴力集团的意志，而在合作社会则更多社会理性。意志或理性，均受制于一定的物质生活条件，因而法本质最终是利害格局的历史诉求。

Sociology Analysis of Jurisprudence

Jurisprudence is legal essence.Legal essence abs tracted from the law .The law stems from the society.The society is made by the groups which has the different ability with consecrating and injuring.Therefore the society forms th e structure of advantages and disadvantages.In this case,the society could be ab le to divided into three categories:the equal structure;the conflicted structure ;the cooperative structure.As the regulator of the social relations,the law is t he dynamic reflection of social structure.It shows the will of ruled class in t he conflict society,and the social reason in the cooperative society.
