摘    要:房产新政推出后,出现了很多房产合同纠纷,买卖双方的分岐很大。各地法院判决不一。界定房产新政究竟是不可抗力、情势变更还是商业风险与当事人有直接的重大利害关系。依法解决新房产合同纠纷,关键是准确理解什么是市场系统固有的风险,什么是显失公平,什么是不可抗力。依法公平解决纠纷才能维护市场秩序和交易安全。

Abstract:Disputes in contracts of real estate arose after new policies of real estate were issued.There were huge disputes between the seller and the buyer and different courts had come to different verdicts.The definition of whether the new policy belongs to force majeure,or change of the situation or the business risk has direct conflict of interest with the party.The key to solve the disputes is to exactly understand what the intrinsic market risk is,what obvious unfairness is and what force majeure is.To settle disputes by law can maintain the market order and transaction safety.
