民事虚假诉讼现状及其规制

虚假诉讼案件的频发对现有的诉讼法律制度产生了消极影响。从虚假诉讼的本质及表现形式出发,通过对虚假诉讼产生的原因即社会诚信体系缺失,成本收益失衡,审判机制的内在缺陷及制裁措施乏力等方面的分析,运用比较法学和实证分析法学方法构建对虚假诉讼的防治体系,其中内涵国民诚信意识建立及司法,立法体制改革。

Current Situation of Deceitful Civil Procedure and Its Control

Frequency of false lawsuits has had a negative impact on present lawsuit system.Starting from its essence and form,the paper analyzes causes such as lack of social credit system,imbalance of costs and benefits,the inherent weaknesses of the trial mechanism and sanctions.Through the comparative law and the evidence analysis law,the paper constructs the control system of false lawsuits,namely,building of national integrity awareness and legislative reform.
