| 摘 要： | 由于甘青藏区所处宋夏沿边的特殊战略位置,以及错综复杂的西北边疆民族关系,宋朝在甘青藏区相继实施了以"和断"为核心、以重罪轻罚为变通的"因俗而治"的刑事法律政策,并强调民族边区人道主义的刑罚处罚方式。结合对此问题的探讨,考察宋代边疆民族法制的独特地域特色,有着积极的现实意义。

| Abstract: | Due to the special strategic location of Gansu Qinghai-Tibet area during Song and the complex ethnic relations in Northwest Frontier,A kind of special Criminal Law and Policy,the core of which was harmony according to the customs and local law,was used in Gansu Qinghai-Tibet Area During Song Dynasty.This article tries to make a study on this issue in order to examine the unique legal system during Song dynasty. |
