| 摘 要： | 现行农村土地承包制度存在不利于保障农民土地承包经营权,不利于保障农民在土地被征收、征用情况下获得补偿等权益,易造成耕地流失以及影响农村劳动力的合理流动等弊端。为此,应实施农民土地有限制所有权制度。
