儒法思想与中国法制研究

儒家思想作为封建正统思想,几千年来深刻影响着中华民族的风俗、文化和国人的思维模式。法文化作为中华文化的重要组成部分,无疑受到了儒家思想的影响,进而在法制上表现了儒家的思维模式。法家思想与儒家思想相对立而产生,并始终伴随着中国第一个封建集权国家———秦的建立、兴盛和灭亡,秦的全部政治实践、法制实践都以法家思想为导向。随着朝代的更替,法制的衍进,儒家思想和法家思想逐渐由对立走向了融合,共同指导中华法制。本文拟从儒家思想和法家思想的特点出发,进行比较,旨在探索两种思想的切合点及它们与中华封建法制的切合点,进而联系现代法制建设,为现代法制建设提供参考。

Study of Confucian - Faism Ideology and the Chinese Legal System

As a feudal orthodox ideology, Confucianism made a great impact on the Chinese customs,culture and thinking Jurisprudence,which is in important part of Chinese culture,was also affected by Confucianism and embodied the Confucian thinking.The legalism that accompanied the establishment,development and destruction of the Qin Dynasty came into being together with Confucianism although they are opposite.The legalism guided the politics and legal practice throughout the dynasty.With the development of history,the two ideologies began to merge,affectig the Chinese legal system.To explore the point of their connection and to probe the connection between the ideologies and the system,this paper makes a comparison between the ideologies with a purpose of providing reference for modern legal system institution.
