| 摘 要： | 自新刑事诉讼法通过后，我国对刑事和解有了较为明确的法律规定，对刑事和解适用范围的争论也有了排除重罪案件适用的官方定论，但在当今中国被害人保障制度缺失的情况下，适当允许重罪案件适用刑事和解却是司法实践中的迫切要求，因而在一定的限制条件下，刑事和解的适用范围应适当扩大。

| Abstract: | Since the new Criminal Procedure Law was passed, there have been clear legal provisions on criminal reconciliation in our country and the official verdict on eliminating felony has been clarified on the application scope of criminal reconcihation. However, due to the lack of victim security protection system, the application of criminal reconciliation in felony cases is the urgent requirement of justice administration. Therefore, under certain limitations, criminal reconciliation should be applied in larger area. |
