论体育法的价值

作为法律科学的应用性分支学科的体育法学,体育法的价值研究关乎着体育法学理论的基本立场和体育法律实践的目标确定。通过归纳演绎的方法,首先对哲学意义上的价值进行讨论,以确定"法的价值"的含义,进而得出体育法价值的概念,即是指体育法所应具有的,同社会与社会成员对于体育的欲望、需要等相符合、相一致或相近的最基本的性状、属性或作用,并分析了体育法价值的主体、客体及内容——体育法的正义价值、自由价值和秩序价值。通过对体育法价值问题的粗浅讨论,以期能引起体育法学界和法律界对体育法学基础理论的关注,并最终来推进中国体育法学理论和体育法律实践的发展。

On the Value of Sports Law

As a practical branch of legal science discipline,the value of sports law study concerns the basic standpoint of the theories in sports law and the goal-setting of sports law and practice.By inductive and deductive method,the authors of this research have discussed the value of its philosophical significance to determine the contents of the legal value and obtained the concept of the value of sports law,which refers to what it is supposed to have and the most basic characteristics,attributes or functions that are consistent with or approximate to the desire and the need of the society and its members for sports.Furthermore,the subject,object and the contents of the value of sports law including the fair value,free value and order value in sports law have also been analyzed.Through a rough discussion of the value of sports law,the authors tend to arouse the attention to the basic theories in sports law science by the academic field of sports law and the legal circle so as to advance eventually the development of sports legal theories and the sports law and practice in China.
