产业化中农产品地理标志保护与发展的法律问题

农产品地理标志是一种集体性权利，在产业化中保护与发展农产品地理标志。会出现很多必须处理的新情况新问题，包括地理标志私权利属性的变化问题；与原产地名称、原产地证明商标或集体商标之间的冲突问题；产地内、外生产经营者的权利分享问题；农产品品牌差异性的保持与淡化问题。还要解决产业发展升级、产业发展理念转变、保护与发展模式定位、保护与发展中的当前利益与长期利益兼顾问题。此外，产业化中农产品地理标志保护与发展的主体应该是多元的，包括政府管理机构的主导、农产品行业协会的参与、农民专业合作组织的配合、企业的支撑和农民的支持。

The Legal Problems in Gographical Indication of Agricultural Products Protection and Developrnent
