摘    要:商品房买卖中的欺诈行为异常突出。为了保护消费的合法权益,促进房地产业的健康发展,建立产业信用,商品房买卖应该适用《消费权益保护法》。同时对该法也应考虑作必要的修改,赋予法官必要的自由裁量权,以适应现实的需要。

Abstract:With a higher and higher incidence of frauds in commercial house property transactions, commercial house property transactions should fall into the law of customers rights protection to protect the customers' legal rights on one hand and to guide the healthy development of the trade line and to establish the credit system one the other hand. Meanwhile, the law should be amended necessarily to meet the demand of the real life, granting reasonable discretionary power to judges.
