反垄断立法的困境与反垄断的未来出路

我国《反垄断法(草案)》已进入人大审议,但反垄断立法依然面临难以解决行政垄断问题、执法机构权力被肢解、立法整合困难、屈从于产业政策和政府管制的需要等困境。我国反垄断立法陷入困境,既根源于我国垄断的特殊性和复杂性,又受制于转型时期制度变迁的影响,更是立法公共选择与利益博弈的结果。要解决我国的垄断问题,仍需改革的纵深推进、竞争文化的培育和反垄断法的不断完善。

Difficult Position and Future Way Out for Antimonopoly Legislation

Antimonopoly Law(Draft) of our country is under the NPC discussion ,but it is still faced with such problems as administration monopoly difficult to solve,law enforcement organ power 's being dismembered,difficult legislative integration,yielding to the need of industrial policy and government control,etc.It find itself in a tight corner,which has its source in Chinese monopoly's particularity and complexity,is under the control of the influence of system change during the period of transition,and is the result of legislation public choice and interest game.We need to further promote reform,cultivate competitive culture and improve Antimonopoly Law,then the problem of Chinese monopoly can be solved.
