| 摘 要： | 何为司法公正，司法公正与程序公正的关系如何，以及如何实现司法公正等问题，是目前诉讼法学界同仁普遍关注的热门话题之一。程序公正是司法公正的前提和基础；程序公正是实体公正的保障；当事人是评价司法是否公正的主体。为了实现司法公正，必须提高法官素质和提高全民族的法律意识。

| Abstract: | The article think that judicial procedure is not only the precondition and base of the judicial justice but also the guarantee of the substantive justice; the party is the body in estimating whether it is justice; in order to realize the judicial justice, we should to raise the quality of the judge and heighten the legal realization of all people. |
