地下空间开发利用法律制度研究

国土空间开发在城市建设中的重要领域是地下空间的开发利用,这对于缓解交通拥堵、节约土地资源等瓶颈问题具有不可替代的作用。在地下空间开发利用过程中,地面塌陷、产权纠纷等问题的频发,涉及诸多法律问题,而且只有解决了民事权利问题,才可以更好地发挥市场对资源配置的决定性作用。我国地下空间开发利用物权法律制度、规划法律制度、环境法律制度和管理法律制度等跟不上地下空间开发利用的速度,达不到推进我国地下空间有序开发利用的目标。为清除我国地下空间开发利用进程中的法律障碍,建立健全以《地下空间开发利用法》为核心的地下空间开发利用法律制度,刻不容缓。

On the Legal Framework Relating to Issues in Underground Space Exploration and Utilization

One important realm of the development of national land resources lies in the exploitation and utilization of the underground space of that nation, which plays an irreplaceable role in mitigating traffic congestions and economizing scarce land resources. However, in the process of exploring and utilizing underground spaces, there often arise a series of legal issues relating to land subsidence, property rights disputes, et cetera. Only when civil rights issues are properly handled can the decisive role of the market in allocating resources be brought into full play. At present, China＇s legal framework concerning property rights protection, land planning, environmental protection and administrative affairs still lags behind the fast speed of underground space development. Therefore, in order to get rid of the legal barriers facing China＇ s underground space exploration and utilization, it is of great urgency for China to establish and improve its legal framework relating to issues in underground space exploitation with the legislation of the ＂Underground Space Development Law＂ at the core.
