论保护学生“学习权利”的法律手段

考察了国内外有关保护学生“学习权利”的法律规范,分析了保护学生学习权利立法的基本理念,认为只有从教育的外部环境和内部环境两个层面入手才能全面完整地保护学生的学习权利。指出从内部环境层面保护学生学习权利实际上是关系到学生“学习权”的界定问题,同时还对学习权的法律意义做了分析界定,为我国将来的相关教育立法提出了若干建议。

To Protect Student's Learning Right in Legislative Method

To protect students'learning right is one of the most important goals of our educatio nal reform.However,the conservative test system prevents o ur good wishes.So to speak,in these days,the crucial action is t o protect students'lawful right;only by legislative means,students can learn freely and creatively.In this article,the aut hor gives the new term"learning right ",in order to protect students'educational right.Our educa-tional reform should be improved continuously,at the same time we must strengthen the legislative means.Education by law and teaching by law should be a new educational idea.The students will never be liberated until they have learning right.
