| 摘 要： | 法律发展的全球化趋势已经是一个不容回避的客观事实。由贸易规则的共同化导致的各国民商法的趋同是很直观的一个例证,人权问题的国际化是更深层次上的法律趋同,两大法系的日益靠拢从形式上缩小了各国国内法的差别。同时,法的历史类型的划分不再是一个重要的法学研究方法,这一切都有力地证实了上述趋势的存在。
