| 摘 要： | 新的《刑事诉讼法》形式上扩大辩护律师的权利 ,但在法律规定和司法实践中存在很大的缺陷和弊端 ,需要在律师的刑事诉讼地位方面 ;在律师辩护中存在的取证难、会见难、阅卷难方面以及如何提高律师辩论权效能方面以立法的形式加以完善 ,以便发挥律师刑事辩护的作用 ,促进司法公正

| Abstract: | The newly-declaimed "Code of Criminal Procedure" has extended the rights of the defense counsel in forms, but has still existed a lot of shortcomings and disadvantages in the law-regularity and judicial practice. Therefore, it needs a advanced-perfection upon the lawyer's status in criminal procedure, upon overcoming the difficulty and barrio of gathering-proofs and interview and checking-up, and upon improving of the defense-effectiveness of the defense counsel in the terms of legislature, so as to safeguard and impulsethe justness of judicature as well as lawyer's role in the procedure of a full criminal defense. |
