| 摘 要： | 随着时代的发展,刑法人道化已经成为历史发展的必然趋势,并且成为国际社会的共识.沈家本主张德主刑辅,重视教化作用;重视人权,反对特权;主张轻刑,反对重刑;尊重人格,反对虐囚等等,他的法制思想不同程度地体现了朴素的人道主义精神.

| Abstract: | With the development of the times,the humane criminal law has become an inexorable trend of the historical development and reached a common understanding of the international society.Shen Jiaben advocated morality to be principal and law punishment subordinate,He emphasized the function of education,attached importance to human rights,opposed the special privilege,demanded light punishment,and went against heavy punishment.He advocated respecting human value and dignity,combated illtreating the prisoner.The plain spirit of humanitarianism embodied to varying degrees in Shen Jiaben's ideology of the legal system. |
